2. Service Description
WinFact is a sports analytics platform that provides data-driven sports picks, analysis, and insights. We use statistical models, market analysis, and other data sources to generate our content. WinFact does not provide bookmaking services, facilitate gambling, or guarantee any outcomes. Our picks and analysis are for informational and entertainment purposes only.
3. User Accounts
To access certain features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when creating your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these terms.
4. Subscriptions & Billing
VIP access to the Service requires a paid subscription. Subscription plans, pricing, and features are described on our pricing page. All payments are processed securely through Stripe. Subscriptions automatically renew unless canceled before the renewal date. You may cancel your subscription at any time through your account settings or the Stripe customer portal. Refunds are handled on a case-by-case basis. Promotional codes are subject to their own terms and conditions.
5. Intellectual Property
All content on the Service, including but not limited to text, graphics, logos, data, analysis, picks, statistical models, and software, is the property of WinFact or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our prior written consent. Your subscription grants you a personal, non-transferable, non-exclusive license to access the content for your own personal use.
6. User Conduct
You agree not to: share your account or subscription access with others; redistribute, resell, or publicly share our premium content, picks, or analysis; use the Service for any unlawful purpose; attempt to reverse-engineer our models or algorithms; use automated tools to scrape or collect data from the Service; harass, abuse, or harm other users; impersonate any person or entity. Violation of these rules may result in immediate account termination without refund.
7. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee the accuracy, completeness, or reliability of any picks, analysis, or content. Past performance does not guarantee future results. Sports betting involves inherent risk, and you may lose money. We are not responsible for any financial decisions you make based on our content.
8. Limitation of Liability
To the maximum extent permitted by law, WinFact and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses, resulting from your use of or inability to use the Service. Our total liability for any claims arising from these terms or your use of the Service shall not exceed the amount you paid to us in the twelve months preceding the claim.
9. Termination
We reserve the right to terminate or suspend your account and access to the Service at our sole discretion, without notice, for conduct that we determine violates these Terms, is harmful to other users or the Service, or is otherwise objectionable. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts located in Miami-Dade County, Florida. You agree to submit to the personal jurisdiction of these courts.
